Waste Removal Streatham Terms and Conditions

These Terms and Conditions set out the basis on which Waste Removal Streatham provides waste removal and related services to residential and commercial customers. By making a booking, confirming a quotation, or allowing us to collect waste from your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

Customer means the person, business, or organisation requesting waste removal or associated services from Waste Removal Streatham.

Services means the waste collection, removal, transportation, recycling, and disposal services provided by Waste Removal Streatham, including any related labour and equipment supply.

Waste means any rubbish, waste materials, or items presented to Waste Removal Streatham for collection, removal, or disposal in connection with the Services.

Site means the property, premises, or location at which the Services are to be carried out.

Agreement means the contract between the Customer and Waste Removal Streatham, incorporating these Terms and Conditions and any written quotation or booking confirmation.

2. Scope of Services

Waste Removal Streatham provides waste collection and removal services, including but not limited to household rubbish clearance, garden waste removal, bulky item collection, light commercial waste, and other non-hazardous waste services. The exact scope of the Services to be provided will be as described in the quotation or booking confirmation issued to the Customer.

Services are provided within our designated service areas, including Streatham and surrounding neighbourhoods, as determined by Waste Removal Streatham from time to time. We reserve the right to decline service to any location where access, safety, or regulatory constraints prevent us from operating in a lawful and safe manner.

3. Booking Process

3.1 Customers may request a quotation or make a booking by telephone, email, or through any other method offered by Waste Removal Streatham. All bookings are subject to availability and acceptance by us.

3.2 When making a booking, the Customer must provide accurate and complete information about the type and approximate volume or weight of Waste, the nature of any items to be removed, access conditions at the Site, and any relevant time constraints.

3.3 Any quotation provided prior to collection is based on the information supplied by the Customer and is an estimate only. The final price may change if, on arrival at the Site, the actual volume, weight, type of Waste, or site conditions differ from those described by the Customer at the time of booking.

3.4 A booking will be confirmed when Waste Removal Streatham issues a booking confirmation, either verbally or in writing, and the Customer accepts the quoted price and proposed service date and time.

3.5 Waste Removal Streatham reserves the right to refuse any booking at its discretion, including where the Waste is not suitable for collection, where the Site is unsafe or inaccessible, or where legal or regulatory restrictions prevent the provision of the Services.

4. Customer Responsibilities

4.1 The Customer must ensure that they are the owner of the Waste or have full authority from the owner to arrange for its removal and disposal. By presenting Waste to us, the Customer confirms that they have the right to dispose of it.

4.2 The Customer must ensure safe and reasonable access to the Site for our vehicles, equipment, and personnel at the agreed time. This includes ensuring that any parking restrictions are addressed in advance and that appropriate permissions or permits are obtained where necessary.

4.3 The Customer must clearly separate any Waste that is subject to specific disposal requirements, such as electrical items, recyclable materials, or items requiring special handling. The Customer must not conceal hazardous or prohibited materials within general Waste.

4.4 The Customer is responsible for complying with any local regulations relevant to Waste storage or presentation prior to collection and for ensuring that any common areas used for access are kept safe and free from obstruction.

5. Access, Parking, and Waiting Time

5.1 The Customer must arrange suitable parking for our collection vehicle as close as reasonably possible to the Site. Where parking charges, tolls, or congestion charges apply, these may be added to the Customer's invoice unless otherwise agreed in advance.

5.2 If our team is prevented from commencing work due to lack of access, absence of the Customer or their representative, or any other issue outside our reasonable control, we may charge a waiting fee or a call-out fee, or we may treat the visit as a cancelled booking as set out in the cancellations section.

5.3 If the Site is not safe or suitable for work to commence, we reserve the right to suspend or cancel the Services until the issue is resolved. Any additional costs arising from such suspension may be charged to the Customer.

6. Pricing and Quotations

6.1 Prices are generally based on the volume, weight, and type of Waste collected, together with labour time, access conditions, and any additional costs such as parking or disposal fees. Any indicative pricing information provided before inspection of the Waste is not binding and is subject to confirmation on Site.

6.2 If, on arrival, we find that the actual Waste or conditions differ significantly from the description given at the time of booking, we will either revise the quotation and seek the Customer's acceptance before proceeding or decline to carry out the Services.

6.3 All prices are stated in pounds sterling and, unless expressly stated otherwise, are exclusive of any applicable taxes, charges, or government levies.

7. Payment Terms

7.1 Payment is due in full upon completion of the Services on the day of collection, unless alternative payment terms have been agreed in advance in writing.

7.2 Waste Removal Streatham may accept payment by cash, bank transfer, card payment, or other methods as communicated to the Customer from time to time. We reserve the right to request full or partial payment in advance for certain bookings.

7.3 For business Customers with approved accounts, invoices are payable within the payment period agreed in writing. If no period is agreed, payment will be due within 14 days of the invoice date.

7.4 In the event of late payment, Waste Removal Streatham reserves the right to charge interest on the overdue amount and to recover any reasonable costs incurred in pursuing the debt, including legal fees and collection charges.

8. Cancellations and Amendments

8.1 The Customer may cancel or amend a booking by contacting Waste Removal Streatham as early as possible. Cancellation or rescheduling charges may apply depending on the notice period given.

8.2 If a booking is cancelled by the Customer more than 24 hours before the agreed collection time, no cancellation fee will normally be charged, unless specific non-refundable costs have been incurred by us.

8.3 If a booking is cancelled by the Customer within 24 hours of the agreed collection time, or if we are unable to carry out the Services due to lack of access, incorrect information, or the Customer's failure to be present, we may charge a reasonable cancellation or call-out fee to cover our costs.

8.4 Waste Removal Streatham may cancel or postpone a booking where necessary due to vehicle breakdown, staff illness, severe weather, safety concerns, regulatory issues, or any event beyond our reasonable control. In such cases, we will aim to notify the Customer as soon as practicable and offer a new appointment time. We will not be liable for any loss arising from such cancellation or delay, except to refund any advance payment for Services not provided.

9. Waste Types and Prohibited Materials

9.1 Waste Removal Streatham collects most common non-hazardous waste, including general household rubbish, furniture, appliances, garden waste, and certain commercial waste streams, subject to legal and operational constraints.

9.2 We will not collect hazardous or prohibited materials unless expressly agreed and properly arranged in advance in compliance with applicable regulations. Prohibited materials may include, without limitation, asbestos, clinical or medical waste, corrosive substances, chemicals, solvents, gas bottles, explosives, and any waste classified as hazardous under UK law.

9.3 The Customer must not present hazardous or prohibited materials for collection as part of general Waste. If such items are found mixed with other Waste, we may refuse to collect the Waste, apply additional charges for safe handling and disposal, or return the Waste to the Customer if already loaded, where legally permissible.

9.4 The Customer is responsible for any fines, penalties, or additional disposal costs arising from misdescription or concealment of hazardous or prohibited materials.

10. Compliance with Waste Regulations

10.1 Waste Removal Streatham operates in accordance with applicable UK waste management legislation and guidance, including requirements relating to waste carrier registration, duty of care, and transfer documentation.

10.2 By using our Services, the Customer acknowledges that we may need to record details of the Waste, the origin of the Waste, and the destination facility in waste transfer documentation. The Customer agrees to provide any information reasonably requested for this purpose.

10.3 We will take reasonable steps to ensure that Waste is reused, recycled, or disposed of at appropriately licensed or permitted facilities, in line with current regulations and good industry practice.

10.4 Title to the Waste will normally pass to Waste Removal Streatham upon loading onto our vehicle unless otherwise agreed in writing, on the understanding that waste disposal is undertaken in a lawful and responsible manner.

11. Liability and Limitations

11.1 Waste Removal Streatham will exercise reasonable care and skill in the performance of the Services. However, we shall not be liable for any loss or damage arising from circumstances beyond our reasonable control, including access issues, structural weaknesses at the Site, or pre-existing damage to property.

11.2 The Customer is responsible for protecting floors, surfaces, and fittings, and for removing or securing any fragile or valuable items that may be affected by the movement of Waste or equipment. We will not be liable for accidental damage to such items where reasonable care has been taken.

11.3 If our team agrees, at the Customer's request, to move items within the property that are not being disposed of, this will be carried out at the Customer's risk, and we accept no liability for damage to such items or the surrounding area unless caused by our negligence.

11.4 To the fullest extent permitted by law, Waste Removal Streatham's total liability for any claim arising out of or in connection with the Services shall be limited to the total price paid or payable by the Customer for the particular Service giving rise to the claim.

11.5 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where liability cannot lawfully be limited or excluded.

12. Complaints

12.1 If the Customer is dissatisfied with any aspect of the Services, they should notify Waste Removal Streatham as soon as possible, ideally within 48 hours of completion of the work, giving full details of the issue.

12.2 We will investigate any complaint in good faith and may request further information or evidence. Where appropriate, we may offer a remedy, which may include a repeat service, a partial refund, or another resolution at our discretion.

13. Insurance

13.1 Waste Removal Streatham maintains appropriate insurance cover in relation to its operations, including public liability insurance, subject to policy terms, limits, and exclusions.

13.2 Details of our insurance cover are available upon reasonable request. Any claim that may give rise to a claim under our insurance must be notified to us promptly.

14. Data Protection and Privacy

14.1 We collect and process personal data such as contact details, service addresses, and payment information for the purpose of providing the Services, managing bookings, processing payments, and handling enquiries.

14.2 We will handle personal data in accordance with applicable UK data protection laws and will take reasonable steps to keep such data secure and confidential.

14.3 By using our Services, the Customer consents to the processing of their personal data for these purposes. The Customer may contact us at any time to request access to or correction of their personal information held by us.

15. Termination

15.1 Waste Removal Streatham may terminate the Agreement or suspend further Services with immediate effect if the Customer commits a serious or persistent breach of these Terms and Conditions, fails to pay any amount due, or engages in behaviour that is abusive, threatening, or unsafe towards our staff.

15.2 Termination will not affect any rights or obligations that have already accrued to either party as at the date of termination.

16. Amendments to Terms and Conditions

16.1 Waste Removal Streatham may update or amend these Terms and Conditions from time to time to reflect changes in the law, industry practice, or our operational requirements.

16.2 The applicable version of these Terms and Conditions is the version in force at the time of the Customer's booking. Continued use of our Services after any changes take effect will constitute acceptance of the updated terms.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

17.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or their subject matter.

18. General Provisions

18.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid or unenforceable, that provision shall be deemed deleted, and the remaining provisions shall continue in full force and effect.

18.2 No failure or delay by Waste Removal Streatham in exercising any right or remedy under these Terms and Conditions shall operate as a waiver of that or any other right or remedy.

18.3 The Agreement is between Waste Removal Streatham and the Customer. No other person shall have any rights to enforce any of its terms.

18.4 These Terms and Conditions, together with any quotation or booking confirmation, constitute the entire agreement between the parties in relation to the Services and supersede any prior discussions, correspondence, or representations.
